Verify Marion Released Mugshot Identity
Before relying on a photo, connect it to the correct person and episode. Compare the full legal name, aliases, birth date, OID or booking number, facility, arrest date, and Marion court case. Common names and reused news images create real error risks. Save the source and access date without publishing personal data that is not needed.
Then verify custody separately. Search both WVDCR jail and prison systems. Check VINELink and the signed court order. A photo on an active jail detail points to a reported current record at access time. A prison photo may relate to a later state sentence. A news image may predate release by months or years. Only an actual movement or release record answers when and how the person left custody.

West Virginia Code section 62-1-6a is narrow. For the law's defined minor offenses, a covered law-enforcement agency generally may not publish a booking photo on its social-media page unless a listed condition applies. Examples include a conviction based on the conduct, a fugitive or imminent-threat need where publication assists location or reduces the threat, or a court order grounded in a legitimate interest.
When a covered agency did publish the photo, the law creates a request-based removal path after specified favorable outcomes such as dismissal, no bill, acquittal, or a conviction later reversed, vacated, or nullified. The section sets a 14-day agency removal period for a valid request. It is not a blanket ban on public booking photos, and it does not compel every news archive, search engine, private page, or DCR system to remove an image.
This social-media request is not the same as expungement. It is also not a general anti-pay-to-remove law. No enacted broad West Virginia anti-pay-to-remove statute was found. Keep the agency request, any court expungement petition, and any correction request as separate remedies with different standards.
