WVDCR Marion Prison Releases

WVDCR operates West Virginia state prisons and the regional-jail system, but its public Offender Information System separates those populations. A Marion defendant may begin at North Central Regional Jail and later enter the prison side after sentencing. The prison assignment can change. Do not guess the receiving institution from the Marion case or from the last jail entry.

A direct prison release may place the person in the community on discretionary parole, statutory mandatory or conditional supervision, or final discharge. Parole ends confinement while a supervised part of the sentence remains. Mandatory supervision can also put the person in the community under DCR authority. Final discharge ends the sentence or supervision identified in that record.

Transfer is not release to the community. A detainer may send a person to another state, federal, or immigration custodian. The actual WVDCR movement entry should identify the date, legal type, and destination. A missing prison result alone cannot supply those facts.

Confirm WVDCR Marion Releases

Use full name, date of birth, OID, sentencing county, and Marion case number. Search the prison side for a state sentence, not merely the regional-jail side. During research the direct prison application returned an access block, so the exact labels on a discharged public result were not verified. Copy the live labels rather than promising that all released people remain searchable.

1. Open the WVDCR Offender Search gateway and choose the prison search.
2. Search by name or OID as the live form allows. Compare date of birth, facility, sentence, and case details.
3. Record the exact status and date labels with the access date.
4. Check the jail side if the path began at NCRJCF. A jail disappearance followed by a prison match indicates transfer, not community release.
5. Review the Marion circuit order in WVPASS and obtain the signed sentence or later order from the clerk.
6. Check VINE and parole sources when the record suggests supervised release.
7. Request the actual WVDCR movement or release record for a durable answer.

WVDCR Release Records Contact

WVDCR is the custodian for its prison intake, sentence calculation, movement, and release records. The Marion sheriff may hold an arrest report, and a Marion court holds its orders, but neither replaces the DCR prison record. Send a focused written request to the DCR Commissioner as custodian. Ask for existing records rather than a custom certificate.

Name the person, date of birth, OID, Marion case, approximate custody dates, and relevant prison if known. Request the admission or commitment, movements, actual release date and time if maintained, release authority and type, destination, final or revised calculation, and supervision status. Ask for segregable nonexempt portions in electronic form.

West Virginia FOIA calls for a response or notice of availability within five working days, excluding weekends and legal holidays, unless an extraordinarily broad request is handled by written agreement. That period governs the response, not guaranteed completion of a large production. Actual reproduction cost may be charged, so ask for an estimate.

Marion State-Prison Path

No adult state prison was found physically in Marion County. A Marion defendant sentenced to state imprisonment may move from NCRJCF to the prison WVDCR assigns. The assignment is an administrative custody fact and can change. Use the current OIS match instead of naming a guessed prison.

NCRJCF’s full name includes “Correctional Facility,” but that wording does not erase the custody split. The state gateway offers distinct jail and prison searches, and different populations can pass through the same complex. Search both sides using the same identifiers. A sentenced person may also move through intake elsewhere before the long-term assignment appears.

The court and corrections records have separate roles. The signed Marion sentencing order states the legal sentence and credit. WVDCR calculates time, assigns the prison, and records movement. The Parole Board decides parole matters. A complete release check uses the source that owns each fact.

WVDCR Marion Release Dates

WVDCR Policy 454.10 uses “minimum discharge/final release date” for the scheduled sentence release if incarceration continues and no good time is lost. Policy 151.06 says the computer calculation starts from the maximum term and can include jail credit, good time, and street credit. Staff update the time sheet and OIS when a factor changes.

Under West Virginia Code §15A-4-17, eligible adults earn one day of good time for each day incarcerated, including qualifying presentence jail credit. Life sentences earn none. Discipline can forfeit credit, Commissioner approval may restore it, and court corrections or resentencing may change the base sentence.

No general West Virginia 85-percent rule was found in the reviewed statewide provisions. Offense-specific minimums and parole limits still apply. Treat a future date as a calculation, then request the actual WVDCR release entry after departure.

WVDCR Parole and Discharge

Parole eligibility and release are separate events. The Parole Board schedules consideration in the eligibility month, but the date creates no right to release. A hearing can end in a grant, denial, deferral, or contingent grant. The monthly calendar is replaced at one URL and is not a decisions archive.

Once parole is granted and release is completed, WVDCR Parole Services supervises the person. Under §62-12-18, the parole term relates to the maximum sentence less lawful deductions. Early discharge may be requested after statutory conditions are met. A parole release date therefore does not equal final discharge.

WVDCR Transfer and Detainers

A person leaving a WVDCR prison may be transferred to BOP, ICE, USMS, another state, or another facility. The BOP locator covers federal sentences and can show release information. ICE has its own detainee locator. USMS does not publish a historical roster like BOP. None of those federal systems is part of the WVDCR prison search.

VINE also has a transfer caveat. DCR does not make a notification call while the person is moving, then sends notice after arrival. During that gap, do not treat silence as community release. Look for the receiving facility and ask WVDCR for the destination field in the movement record.

Note: A WVDCR exit to another custodian ends one facility record but does not end governmental custody.

WVDCR Marion Record Fields

A useful release request identifies the person and one custody episode. “Not found” is not a release record. Ask for the database fields or documents that distinguish sentence completion from parole, supervision, or transfer.

Public OIS is only a view into selected information. Exempt material may be redacted, and WVDCR need not create a new answer when no responsive record exists. Request existing fields with reasonable specificity.
