West Virginia Registry Scope
The West Virginia Sex Offender Registry is a specialized record system operated by the West Virginia State Police. It is not a jail, prison, release list, or complete roster of people under supervision. Chapter 15, Article 12 defines who must register and connects registration duties to events that can include release, parole, or probation. Most people released from Marion custody are outside this system.
A qualifying registrant may remain searchable after leaving a regional jail or state prison. That continued visibility can support identification and the fact that registry duties apply. It cannot replace the release record. The registry does not establish the precise gate time, release authority, sentence computation, or whether another custodian once received the person.
After West Virginia Registry Release
Registration can follow different legal paths. A person may leave NCRJCF under a court order and have a duty tied to the covered offense. Another person may leave a WVDCR prison on parole or conditional supervision. Someone on probation may have served little or no prison time. Registration, parole, and probation are distinct duties administered through different sources.
West Virginia Code §§15-12-4 and 15-12-6 connect reporting and duration rules to the person's legal status and qualifying offense. The exact obligation must be read from the current law and official record. Do not infer the start, end, or length of registration from a custody roster. Likewise, the existence of a registry entry does not show that parole or probation remains active.
To find the custody route, search WVDCR's jail and prison systems, check VINE, and inspect the Marion court case. If the person left NCRJCF for a prison, that was a transfer. If WVDCR recorded parole or conditional release, physical custody ended while supervision continued. Final discharge is a different event and does not necessarily erase a separate statutory registration duty.

Begin at the official West Virginia State Police registry entry. Read the disclaimer before searching. Use the person's exact identity and compare the displayed photograph, identifying data, offense information, and registration details. Common names require care, and address-related information can change.

- Search with the most accurate legal name and identity details available.
- Compare the photograph and offense or registration data to the known Marion record.
- Save the access date and exact labels because information may be under verification or later corrected.
- Use WVDCR and the court to confirm the separate custody release event.
The registry warns that information may change or be under verification and does not guarantee accuracy. Its terms also forbid harassment. Treat the result as an official but limited registry record. Report a possible error through WVSP rather than publishing an unverified correction.

A reader should quote the exact live label rather than recasting it as a corrections status. “Registered” is not the same as “on parole,” “on probation,” “discharged,” or “in custody.” Those terms belong to supervision, courts, and corrections records.
Confirm Marion Registry Release
Use the registry after establishing that it applies to the right person. Then build the release answer from the actual custodial systems. A current WVDCR jail match reports regional-jail custody. West Virginia Registry Release Law
West Virginia Code §15-12-2 defines covered registration terms and requirements. Section 15-12-4 addresses registration in connection with release, parole, probation, and related events. Section 15-12-6 governs registration periods. Section 15-12-10 addresses the public registry and its administration. Read the current provisions together because one section alone does not define every duty.
The registry law is separate from the law that controls expungement of qualifying arrest and court records. An expungement analysis depends on the offense and current statutes, and many convictions are excluded. Never assume that a general record-removal order changes a statutory registry duty without legal authority that applies to that exact person and case.

A correction request should identify the exact displayed field, the matched person, the date accessed, and the official document that supports the correction. Request Marion Release Records
When the goal is to prove physical release, request the record from WVDCR rather than asking WVSP to infer it from registry data. Identify the full name, date of birth, OID if known, NCRJCF or prison custody episode, and approximate dates. Seek existing admission, movement, actual release date and time if maintained, legal release type, and destination.
West Virginia FOIA requires a public body to respond, advise when and where records will be available, or deny in writing within five working days, excluding weekends and legal holidays. The response period is not a promise that a broad production will be finished in five days. Ask for electronic copies, a cost estimate, segregable nonexempt material, and the legal basis for each withholding.
Pair the response with the signed Marion court order and registry result. This gives each source a clear role: WVDCR documents custody, the court documents authority, and WVSP documents registration. Keeping those roles separate prevents a specialized registry entry from being misread as a release certificate.
West Virginia Registry Limits
Registry absence does not establish release, custody, innocence, discharge, or the lack of a criminal case. It most often means only that no matching public entry is displayed under the search used. The person may not be subject to registration, the query may be wrong, data may be under verification, or another legal access limit may apply.
A registry match also has limits. It does not prove that the person remains at a listed location at the moment of search, and WVSP expressly cautions that information can change. It does not replace a court order or WVDCR actual movement entry. Follow the registry's rule against harassment and report errors through the official channel.
The sound post-release statement is specific: a matched person appears in the West Virginia registry as of the access date, while a separate WVDCR or court record establishes the custody event. Do not state that the registry covers all Marion County released people. It does not.
